Should I Sell My Las Vegas Rental Vacant or With the Tenant Still In It?

It is case by case, and it mostly comes down to how fast you want to sell and get your money. A vacant rental is open to every buyer, including families who want to live there, which usually means more offers and a higher price. A rental with a tenant in place is usually only available to investors, who have to honor the lease. Vacant: the doors are open to everyone

When the house is empty, anyone can buy it: first time buyers, families, move up buyers, and investors. More buyers means more competition, and that is usually what brings the highest price. The house can be shown any time, cleaned up, and photographed at its best. The trade off is that you give up the rent while it is on the market.

Tenant in place: usually investors only

If a tenant has a lease, the buyer has to honor that lease by law (Nevada's rule for voluntary sales, NRS 118A.349), and the security deposit transfers to the buyer at closing. That rules out most people who want to move in, so your buyer pool is mostly investors. Investors buy on the numbers, so a tenant paying solid rent can still get you a fair price, and you keep collecting rent until closing.

What the lease length changes

  • Long lease left. Realistically, the house is an investor sale, and the buyer takes over the lease. There is always room to talk with the tenant about leaving early in exchange for money to move. If the tenant agrees, get it in writing, with the move out date and the payment spelled out, before you rely on it. Then anybody can buy it.
  • Month to month. You have the most flexibility. If you rely on the rent and do not want the house sitting empty, we can still sell with the tenant in place. If you want the widest buyer pool, the tenant can be given proper notice before listing.
  • Lease ending soon. Sometimes the best move is to wait a few weeks for it to end, then list vacant. Keep in mind a lease end date is not an automatic move out date; the proper notice still has to be given. Again, it depends on your timeline and finances.

How showings work with a tenant

In Nevada, the landlord has to give the tenant at least 24 hours notice before a showing, and showings have to be at reasonable times during normal business hours unless the tenant agrees otherwise. That means the house is rarely available on short notice, and when a house cannot be shown when buyers want to see it, you can lose buyers. The rule always applies. What makes it work is good communication on top of it: respect the tenant's schedule, give proper notice every time, and ask for their cooperation. Many tenants will agree to a set showing schedule or a shorter notice visit when asked nicely. When the tenant is on board, showings go smoothly. When they are not, we may recommend waiting until they move out, depending on the situation.

Usually vacant, because the house is open to every buyer, not just investors. A tenant paying good rent can still bring a fair price from an investor, and you keep the rent until closing.

Can I sell my Las Vegas rental while the tenant still has a lease?

Yes. The buyer takes over the lease and has to honor it. Most of those buyers are investors.

Can I ask my tenant to move out so I can sell?

You can always ask, and many tenants will agree in exchange for money to move. If they agree, the house opens up to all buyers. If not, the lease stands.

How much notice do I have to give my tenant for showings in Nevada?

At least 24 hours, and during normal business hours unless the tenant agrees otherwise. Good communication alongside the rule is what keeps a house easy to show, because a house that is hard to show loses buyers.

Should I wait for the lease to end before selling my rental?
